Whether purchasing an apartment as an investment or for owner-occupation, the German Real Estate Agents and Developers Ordinance (MaBV) protects buyers by stipulating that payments to the developer may only be made in stages, in accordance with the progress of construction.. The developer is permitted to combine the 13 installments specified in the regulation into a maximum of 7 partial payments.
MaBV Payment Stages
An MaBV-compliant payment plan may, for example, be structured as follows:
- 30% upon commencement of earthworks
- 28% upon completion of the structural shell (including carpentry work)
- 5.6% for completion of roof surfaces and gutters
- 15.4% for installation of windows, interior plastering, screed, and facade works
- 9.1% for the rough installation of heating, sanitary, and electrical systems, as well as tiling works in sanitary areas
- 8.4% upon readiness for occupancy, payable step by step against transfer of possession
- 3.5% upon full and final completion
→ The final payment becomes due only once the building has been fully completed.
